Q: What is Buycott?
A: Buycott is a tool that lets you organize your consumer spending to help causes that you care for, and to oppose those that you don't.
Q: How does it work?
A: Scan a barcode with the Buycott app and it will look it up in our database and try to determine who owns it. Buycott will then trace the product's ownership back to its top parent company and cross-check this company against the campaigns that you've joined before telling you whether it found a conflict.
Q: What does a campaign consist of?
A: A campaign must have a goal, and a list of companies that it aims to either support or avoid (buycott or boycott). Look for campaigns organized around goals that you share, or create a campaign if you can't find what you're looking for.
Q: How does it figure out all the corporate relationships?
A: Buycott has a rich, but ultimately limited knowledge base of corporations and products. When you scan a product not in the Buycott database, it will ask you for help in identifying the product name, brand name, and company name.
Q: I scanned an unknown product and I want to add it to the database. How do I determine what to call the product, brand, and company?
A: Sometimes we will input our best guess at what the product is by autopopulating the input field. You can alter the data if you find that the information doesn't match the product the barcode you scanned. The company name should be the registered business entity of that product's immediate parent company. This will almost always be on the packaging of the product. The brand name is generally the word(s) on the front of the packaging with the largest font size.
Q: Is all the data guaranteed to be accurate?
A: No. Corporate ownership structure is always changing and can sometimes be complex. Most companies in our database actually own more brands than we have on record for them. That's why we need your help maintaining and improving the integrity of the data. New users can add unknown products they scan, and also contribute contact and background information for existing companies or vote on the accuracy of information that's already been added. The most active users have the ability contribute more types of data to the database.
Like most website operators, Buycott collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Buycott’s purpose in collecting non-personally identifying information is to better understand how Buycott.org’s visitors use its website. From time to time, Buycott may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
Buycott also collects potentially personally-identifying information like Internet Protocol (IP) addresses. Buycott does not use such information to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.
Certain visitors to Buycotts websites choose to interact with Buycott in ways that require Buycott to gather personally-identifying information. The amount and type of information that Buycott gathers depends on the nature of the interaction. For example, we ask visitors who use our forums to provide a username and email address. In each case, Buycott collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Buycott. Buycott does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.
Buycott may collect statistics about the behavior of visitors to its websites. For instance, Buycott may reveal how many downloads a particular version got, or say which plugins are most popular based on checks from api.Buycott, a web service used by Buycott installations to check for new versions of Buycott and plugins. However, Buycott does not disclose personally-identifying information other than as described below.
Buycott discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on Buycott’s behalf or to provide services available at Buycott’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Buycott’s websites, you consent to the transfer of such information to them. Buycott will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors, and affiliated organizations, as described above, Buycott discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when Buycott believes in good faith that disclosure is reasonably necessary to protect the property or rights of Buycott, third parties, or the public at large. If you are a registered user of a Buycott website and have supplied your email address, Buycott may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Buycott and our products. We primarily use our blog to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Buycott takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally-identifying information.
Effective as from December 12, 2012.
Buycott reserves the right to update the Website and these Terms of Service from time to time, at our discretion and without notice. Nevertheless, this document is public on Buycott, and you will be able to track the changes for any new version. Your continued use of the Website following the publishing of updated Terms of Service means that you accept and agree to the changes.
Campaigns that attempt to infringe upon the rights of others based on race, gender, relgion, or sexual orientation are not tolerated.
Your use of Buycott is at your sole risk. The service is provided "as is" and "as available". We disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for damages, direct or consequential, resulting from your use of the Website, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses (including but not limited to attorney's fees) arising from your violation of any third-party's rights. You acknowledge that you have only a limited, nonexclusive, nontransferable license to use the Website. Because the Website is not error or bug free, you agree that you will use it carefully and avoid using it ways which might result in any loss of your or any third party's property or information.
This Agreement will become effective in relation to you when you create a Buycott account or when you start using the Buycott Service and will remain effective until terminated by you or Buycott. Buycott reserves the right to terminate this Agreement or suspend your Buycott account at any time in case of unauthorized, or suspected unauthorized use of the Buycott Service whether in contravention of this Agreement or otherwise. If Buycott terminates this Agreement, or suspends your Buycott account for any of the reasons set out in this section, Buycott shall have no liability or responsibility to you.
Buycott respects intellectual property rights, and expects you to do the same. The Buycott Service and the content provided through the Buycott Service is the property of Buycott or Buycott's licensors and protected by intellectual property rights (including but not limited to copyright), and you do not have a right to use the Buycott Service (including but not limited to its content) in any manner not covered by the Agreement. Furthermore, you must not infringe any third party's intellectual property rights in using the Buycott Service. Further, you may not remove or alter any copyright, trademark or other intellectual property notices contained on or provided through the Buycott Service.
If you are a copyright holder who believes that any of the products, services or content which are directly available via the Buycott Websites are infringing copies of your work, please let us know. Pursuant to The Digital Millennium Copyright Act, 17 United States Code 512(c)(3), a notice of alleged copyright infringement should be sent to Buycott's designated copyright agent at the following email address: Buycott Attn: Legal Department [email protected] A notification of claimed copyright infringement must be addressed to Buycott's copyright agent listed above and include the following: A physical or electronic signature of the owner (or person authorized to act on behalf of the owner) of the copyright that is allegedly infringed; Specific identification of each copyrighted work claimed to have been infringed; A description of where the material believed to be infringed is located on Buycott Service or the Buycott Websites (please be as detailed as possible and provide a URL to help us locate the material you are reporting); Contact information for the complaining party, such as a complete name, address, telephone number, and email address; A statement that the complaining party has a good faith belief that use of the work(s) in the manner complained of is not authorized by the copyright owner, its agent, or the law; and A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Buycott will make reasonable efforts to keep the Buycott Service operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. Buycott reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, functions and features of the Buycott Service with or without notice.
Buycott may assign this Agreement or any part of it without restrictions. You may not assign this Agreement or any part of it to any third party.
Should for any reason or to any extent any provision of this Agreement be held invalid or unenforceable, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of this Agreement and the application of that provision shall be enforced to the extent permitted by law.
i. You and Buycott agree that any dispute, claim or controversy arising out of or relating in any way to the Buycott Service or your use thereof, including our Agreement, shall be determined by mandatory binding arbitration. You agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Buycott are each waiving the right to a trial by jury and the right to participate in a class or multi-party action. This arbitration provision shall survive termination of this Agreement and the termination of your Buycott subscription. The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (the "AAA Rules"), as modified by this Agreement, and as administered by the AAA. ii. You and Buycott agree that (a) any claims seeking to enforce, protect, or determine the validity or ownership of any intellectual property rights, and (b) any claims related to allegations of theft, piracy or unauthorized use of the Buycott Service are NOT subject to mandatory arbitration. Instead, you and Buycott agree that the preceding claims (including but not limited to claims for injunctive or equitable relief) shall be exclusively decided by Courts of competent jurisdiction in California, and that applicable California and/or Federal law shall govern, without regarding to choice of law principals. iii. YOU AND Buycott AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER OR IN ANY REPRESENTATIVE CAPACITY OR PROCEEDING. Further, the arbitrator shall not consolidate any other person's claims with your claims, and may not otherwise preside over any form of a multi-party or class proceeding. If this specific provision is found to be unenforceable in any way, then the entirety of this arbitration section shall be null and void. The arbitrator may not award declaratory or injunctive relief. iv. Any arbitration must be commenced by filing a demand for arbitration with the AAA within ONE (1) YEAR after the date the party asserting the claim first knows or reasonably should know of the act, omission or default giving rise to the claim; and there shall be no right to any remedy for any claim not asserted within that time period. If applicable law prohibits a one-year limitations period for asserting claims, any claim must be asserted within the shortest time period permitted by applicable law. Your arbitration fees and your share of arbitrator compensation will be limited to those fees set forth in the AAA's Consumer Rules with the remainder paid by Buycott. Any arbitration costs or fees deemed "excessive" will be paid by Buycott. v. You and Buycott agree that this Agreement involves interstate commerce and is subject to the Federal Arbitration Act. You and Buycott further agree that applicable laws of the State of California shall exclusively govern any dispute without regard to choice or conflicts of law rules. The sole and exclusive venue for the resolution of any dispute, whether or not subject to mandatory arbitration as described above, shall lie in California.
In the event that this Agreement is translated into other languages and there is a discrepancy between the two language versions, the English language version shall prevail to the extent that such discrepancy is the result of an error in translation.
